Notable Cases and Results:  
Sutkiewicz v. Monroe County Sheriff et al, 110 F.3d 352, 361 (6th Cir. 1997) - Plaintiff filed a Section 1983 alleging defendants violated his constitutional rights, maliciously prosecuted him and falsely imprisoned him for ten years on a murder he did not commit. Plaintiff was granted a new trial on appeal when the court held that the trial court committed reversible error when it excluded probative audiotapes of an alleged confession which had the possible effect of negating the probable cause determination. "Because we find the tapes relevant, due to the possible negating effect they may have on the probable cause determination, we hold that the order of the trial court excluding the audio tapes and denying Sutkiewicz's motion for a new trial is erroneous and inconsistent with substantial justice."
