Practice Description:  
Mr. Peters concentrates his practice in environmental and regulatory law matters, with an emphasis on compliance, permitting and the defense of enforcement actions. He represents Fortune 500 companies in numerous states related to water, waste, mining and air permitting issues and compliance, including the myriad environmental requirements related to the purchase and transfer of property. He also represents these clients in civil and regulatory litigation proceedings. In addition, Mr. Peters has defended clients in numerous federal criminal grand jury investigations initiated by the U.S. Department of Justice. His expertise includes proactive environmental compliance advice for companies under federal regulatory schemes including CERCLA, RCRA, EPCRA, Clean Water and Wetland issues, Clean Air Act and the SNAP regulations, coal mining and the federal MSHA regulations, as well as the state analogues to these federal programs.

He also has extensive experience in representing companies in the regulatory arenas governed by the Food and Drug Administration (FDA), the U.S. Department of Agriculture (USDA) and the U.S. Arms Export Control Act and the U.S. Department of State's implementation of the International Traffic in Arms Regulations (ITAR), including the defense of federal actions taken for alleged regulatory non-compliance against companies under these federal regulations. He has advised clients on the interpretation of federal regulatory program requirements, as well as assisted each client in achieving the most cost-effective approach to maintaining regulatory compliance.

Prior to entering private practice, Mr. Peters was employed as assistant chief counsel with the Office of Chief Counsel for the Pennsylvania Department of Environmental Resources in Pittsburgh where he was responsible for litigation and regulatory enforcement activities. Mr. Peters previously worked for Illinois Governor James R. Thompson in Chicago as Assistant Chief Counsel in the Governor's Office of Consumer Services (GOCS), where he concentrated in utility and energy issues.

Mr. Peters lectures frequently on emerging environmental issues of concern and he has also served as a faculty member for the Institute of Continuing Legal Education. He authored "Clean Water Act: Unauthorized Presence Of Fill Material In Wetlands Area Constitutes Continuing Violation For Statute Of Limitations Purposes," The Digest of Environmental Law, December 1996; and the article "[To Avoid Waste Water Enforcement Actions ...] Have All the Information at Hand, Be the First to Know About a Violation, and Report Promptly," published in The Environmental Corporate Counsel Report, April 1995.

Mr. Peters received his bachelor's from the University of Iowa in 1976 and his law degree from the John Marshall Law School in 1980. He is admitted to practice in the States of Michigan, Illinois, Iowa, as well as the Commonwealth of Pennsylvania.
