Practice Description:  
Having argued before both the Illinois Appellate Courts and the Illinois Supreme Court, David L. Cunningham has changed state divorce law and impacted clients' lives for the better.

For many years a highly regarded criminal defense lawyer, Mr. Cunningham practices law because he doesn't like to see people bullied. He has narrowed the focus of his practice to the resolution of divorce cases, in which he protects the interests of spouses, from housewives whose financial well-being is threatened to fathers whose child custody rights are endangered.

A number of Mr. Cunningham's notable trial cases have had a lasting influence on Illinois law, including:

  • In re: Marriage of John G. DeRossett, Appellant, and Cynthia L. DeRossett, Appellee. In which Mr. Cunningham argued before the Illinois Supreme Court and was able to create a clear distinction between marital compensation claims and non-marital compensation claims, which are not divisible in a divorce, This distinction has since been used by Illinois courts as guidance.

  • In re: Marriage of Overton. Prior to Mr. Cunningham's work on this trial, alimony could be terminated upon a spouse's cohabitation with another party. This was the first case where alimony was awarded without regard to cohabitation.

  • Robert L. Moody v. First National Bank of Moline. In this trial, Mr. Cunningham successfully prosecuted a lawyer who stole a workers' compensation settlement from his own client, and that lawyer was sent to prison.
