Practice Description:  
Mr. Factor regularly represents secured creditors, insurance companies, Chapter 7 and Chapter 11 Trustees, debtors-in-possession, debtors, creditors' committees, equity committees, landlords, trade and other unsecured creditors, indenture trustees, and individuals in bankruptcy proceedings, bankruptcy litigation, bankruptcy transactions, out-of-court restructurings, assignments for the benefit of creditors and other procedures utilized by distressed organizations. Mr. Factor has represented parties in cases ranging from some of the largest Chapter 11 proceedings ever filed (e.g., Enron, Conseco and Kmart), to no-asset Chapter 7 proceedings involving individual debtors and abuses of the Bankruptcy Code. Mr. Factor also has extensive experience assisting Trustees administer and liquidate Chapter 11 and Chapter 7 estates, including cases involving complex financial transactions, as well as in representing insurance companies in complex mass tort bankruptcy cases.

In general commercial litigation matters, Mr. Factor has represented corporations and individuals in breach of contract disputes, partnership disputes, disputes among owners of closely-held corporations, and debt enforcement actions, in state and federal courts and before the American Arbitration Association. Mr. Factor also has argued two cases before the United States Court of Appeals for the Seventh Judicial Circuit. Mr. Factor also has experience in alternative dispute resolution procedures, including arbitration and mediation.
